Sedangkan imam Ahmad mengatakan bahwa seorang muslim yang meninggalkan shalat harus dibunuh atas dasar bahwa dirinya telah kafir. Pendapat itu didasrkan pada firman Allah SWT:

فَإِذَا انسَلَخَ الأَشْهُرُ الْحُرُمُ فَاقْتُلُواْ الْمُشْرِكِينَ حَيْثُ وَجَدتُّمُوهُمْ وَخُذُوهُمْ وَاحْصُرُوهُمْ وَاقْعُدُواْ لَهُمْ كُلَّ مَرْصَدٍ فَإِن تَابُواْ وَأَقَامُواْ الصَّلاَةَ وَآتَوُاْ الزَّكَاةَ فَخَلُّواْ سَبِيلَهُمْ إِنَّ اللّهَ غَفُورٌ رَّحِيمٌ

Apabila sudah habis bulan-bulan Haram itu, maka bunuhlah orang-orang musyrikin itu di mana saja kamu jumpai mereka, dan tangkaplah mereka. Kepunglah mereka dan intailah di tempat pengintaian. Jika mereka bertaubat dan mendirikan sholat dan menunaikan zakat, maka berilah kebebasan kepada mereka untuk berjalan. Sesungguhnya Allah Maha Pengampun lagi maha Penyayang. (QS. At-Taubah: 5)

Juga ada dalil dari hadits Rasulullah SAW:

Batas antara seorang dengan kekafiran adalah meninggalkan shalat (HR Jamaah kecuali Bukhari)

Namun pendapat yang rajih (lebih kuat) dalam masalah ini adalah pendapat jumhur ulama yang mengatakan bahwa bila seorang tidak shalat hanya karena alasan malas, lalai atau baru masuk Islam, maka tidak dianggap kafir. Barulah dikatakan kafir kalau dia secara tegas menolak/ tidak menerima adanya kewajiban shalat dalam Islam.
