DEN HAAG - Partai Buruh Belanda meneriakkan rem atas perkawinan Islam karena perkawinan secara Islam yang tidak dikuatkan oleh Catatan Sipil dapat mengarah kepada legalisasi poligami. "Perkawinan ala Islam ini pada dasarnya adalah ilegal", demikian tutur Jeroen Dijsselbloem yang meminta perhatian dalam rapat komisi dengan Menteri Integrasi, Ella Vogelaar.

MAY 08; Mengucapkan "Saya ceraikan kamu" tiga kali, spt layaknya lelaki di negara Muslim selama berabad2 sesuai dgn perintah nabi mereka, kini TIDAK DISETUJUI pengadilan tertinggi Maryland, AS.

Kata pengadilan tsb: "Kalau suami diijinkan mengunakan talaq, maka seorang istri tidak akan pernah dapat menuntut sang suami ke pengadilan dan menuntut haknya atas pembagian harta benda perkawinan. ... Talaq secara langsung menghapus hak istri utk menghadap ke pengadilan dan menuntut haknya atas harta benda perkawinan." :wink:

hehehhhh ... satu lagi syariah yg ditolak Barat karena ketahuan tidak berperikemanusiaan. Mamad ... mamad ... sedang mabuk apa sih kau saat membuat peraturan talaq spt ini ??? :weedman:

BERLIN, negara bagian keenam Jerman, yg MENOLAK Jilbab bagi pegawai negeri

31.03.2004, Civil servants will be forbidden from wearing headscarves in Berlin in the future. The city-state's senate agreed on a bill to ban employees from wearing visible religious symbols, including headscarves, crosses and Jewish scull caps, at work. Berlin's ruling coalition, made up of the Social Democrats and the post-communist Party for Democratic Socialism, spent months debating the issue, which will apply to judges, teachers and police, among other civil servants. Only day-care teachers will be exempt from the ban. Berlin will be the sixth German state to forbid its civil servants from wearing headscarves since Germany's highest court deemed the issue a matter for state regulation last year.

JOGJA JUGA TOLAK RUU PORNOGRAFI :

Ratu Jogja (Muslimah) Tolak UU Antipornografi

JOGJA - Kontroversi pengesahan Undang-Undang Antipornografi terus berlangsung di beberapa daerah di Nusantara. Yang menolak terkesan lebih lantang menyuarakan sikapnya.

Di Jogja, beberapa tokoh masyarakat terlibat dalam aksi penolakan UU tersebut. Salah satunya adalah permaisuri Keraton Jogja Gusti Kanjeng Ratu (GKR) Hemas.

Istri Sultan Jogja Sri Sultan Hamengku Buwono X tersebut hadir bersama ratusan peserta aksi di gedung DPRD DIJ (Daerah Istimewa Jogja) di Jalan Malioboro kemarin. Selain Hemas, tampak pula seniman tenar Jogja Butet Kartaredjasa. ''UU Antipornografi itu sangat tidak jelas. Dalihnya untuk melindungi anak dan perempuan. Tapi, materinya tidak jelas," kritik Hemas berapi-api.

Saat menyampaikan orasinya, Hemas mengikat kepalanya dengan kain putih bertulisan ''Yuk Tolak RUU Pornografi''. Anggota DPD RI itu mengajak semua elemen� bersatu padu menolak RUU tersebut. ''Mari kita tolak bersama-sama," ajaknya semangat.

Sementara itu, Butet dengan gayanya yang menggelitik menyebut mereka yang menyusun UU itu berpikiran ''ngeres''. ''Membangkitkan hasrat seksual itu apa ukurannya. Memang wakil rakyat bisa mengukurnya," ucap seniman monolog itu.

Menurut dia, berfantasi dan berimajinasi adalah wilayah privat sehingga tidak pantas negara mengurusinya. ''RUU itu hanya akan menimbulkan potensi konflik horizontal," ingatnya.

Mantan Ketua Lembaga Ombudsman Swasta (LOS) DIJ Budi Wahyuni juga ikut bicara. Aktivis PKBI itu menilai RUU Antipornografi hanyalah bentuk dari kemunduran berpikir.

Wakil Ketua DPRD DIJ Agus Sulistiyono yang menerima para pengunjuk rasa menyatakan dukungannya terhadap aksi tersebut. Dia pun didaulat meneken pernyataan penolakan.

Setelah beraksi di halaman gedung DPRD DIJ, Hemas kembali ikut turun ke jalan saat beraksi di depan Gedung Agung. Kali ini sejumlah seniman datang bergabung.

Mereka, antara lain, Djaduk Ferianto dan Eko Bebek. Orasi dan pertunjukan seni pun digelar. Aksi itu berlangsung tiga jam, pukul 14.00-17.00. Masyarakat yang ikut mendukung dipersilakan meneken di atas kain putih yang dipasang di pagar Gedung Agung.

Tolak Bala di Solo

Di Solo, komunitas seniman Solo yang membentuk Solo Rayakan Keberagaman (Sorak) menduduki gedung DPRD setempat. Mereka datang untuk melakukan prosesi tolak bala, memprotes pengesahan Rancangan Undang-Undang (RUU) Antipornografi dan Pornoaksi (APP) menjadi undang-undang.

Dimotori seniman tari Suprapto Suryodarma, ratusan seniman membawa sebatang lidi di depan Gedung Paripurna DPRD. Lidi tersebut diberi bawang merah dan cabai yang kemudian ditancapkan di atas potongan batang pohon pisang berukuran sekitar setengah meter.

Sekitar 15 menit ritual itu berlangsung, Mbah Prapto -sapaan akrab Suprapto- pun memanjatkan doa di depan lidi-lidi yang ditancapkan itu. Lidi dipilih sebagai simbol karena jika disatukan akan menjadi sebuah kekuatan untuk membersihkan segala macam kotoran.

''Kotoran dalam hal ini tidak hanya yang pro terhadap RUU APP, tapi yang kontra juga harus membersihkan diri. Pada hakikatnya, RUU APP ini mengandung konflik. Maka, harus disapu bersama-sama,'' katanya.

Prapto menambahkan, RUU APP yang akan disahkan dinilai malah memecah belah kebinekaan di Indonesia. Sebab, ada beberapa pasal yang sebetulnya tidak harus dicantumkan malah ditonjolkan.

Misalnya, pasal 14 RUU yang menyatakan bahwa pembuatan, penyebarluasan, dan penggunaan materi seksualitas dapat dilakukan untuk kepentingan dan memiliki nilai seni-budaya, adat istiadat, dan ritual tradisional. ''Kata-kata seni, budaya, dan adat istiadat yang dikaitkan dengan seksualitas seharusnya tidak dimunculkan. Sebab, malah bikin salah tafsir dan membuat kerancuan,'' tandasnya.

Aksi para seniman itu disambut baik oleh Ketua DPRD Hariadi Saptono. Aspirasi yang disuarakan para seniman diterima Hariadi. ''Pernyataan sikap ini kami terima dan akan kami kirim ke Jakarta untuk ditindaklanjuti,'' ujarnya.

Setelah menerima pernyataan sikap itu, Hariadi ikut menancapkan sebatang lidi ke batang pisang diikuti para seniman lain. Selama aksi, salah satu seniman, Mugiyono Kasido, terus melantunkan langgam Jawa mengiringi setiap langkah para peserta yang akan menancapkan lidi. (un/tej/kus/jpnn/ruk)

The legislation, which was sponsored by state Rep. Paul Curtman, R-Pacific, bans Missouri courts from utilizing foreign law or legal code in any ruling. Although it never specifically mentions the words "Sharia" or "Islam," Wednesday’s debate focused almost exclusively on Sharia law, which is the religious law of Islam.

"This bill is not all about Sharia Law," Curtman said. "It’s Sharia Law, French law, Dutch law or anything else."

Since the beginning of 2009, numerous states have considered proposals to ban Sharia. During last year's elections, Oklahoma voters passed a referendum banning state courts from considering international or Islamic law. However, it was later blocked by a federal judge who said that the law was unconstitutional.

Legislation similar to Curtman’s was introduced in the Missouri Senate by Republican Brian Nieves but has yet to gain traction. The House bill picked up momentum earlier this session when House Speaker Steve Tilley threw his support behind it, saying "the laws of this country should trump any other laws regarding the citizens of our country within our borders"...

Last week, the inaugural Muslim Lobby Day was held at the Capitol, in part due to the anti-Sharia legislation introduced this year.

Despite the criticism from Democrats, Curtman remained resolute that his legislation was needed.

"This bill is about one thing and one thing only, and that is to protect the fundamental rights that are guaranteed to our citizens under our founding documents, in the federal constitution and in our state constitution," he said.

RALEIGH -- A group of Republican legislators is backing a measure that would make it illegal for judges to consider "foreign law" when making rulings in North Carolina's courts.

Though the federal and state constitutions already guarantee the supremacy of U.S. law in domestic cases, primary sponsor Rep. George Cleveland said he is concerned that Shariah law could gain a foothold in American communities with sizable Muslim populations.

House Bill 640 makes no mention of the Islamic legal code. But Cleveland said Shariah would be defined as a "foreign law" under his bill, and therefore banned from North Carolina's courtrooms if the legislation he proposes is approved.

"It's to ensure that any individual in this state does not have to worry about being taken advantage of by foreign laws," said Cleveland, a retired Marine who lives in Jacksonville. "It's barring any international law. If Shariah law tries to be enforced in the state, yeah, it would do it."

ALASKA: Rep. Carl Gatto (R) has introduced SB 88, which invokes the Constitution to make sure that “foreign law is prohibited.”

ARIZONA: Arizona’s anti-Sharia law is HB 2582, the “Arizona Foreign Decisions Act.” In addition to banning the implementation of Sharia law, the bill would also ban “canon law, halacha and karma.”

ARKANSAS: Arkansas’s anti-Sharia bill is SB 97, which says that the “the recognition and enforcement (.PDF) of a foreign judgment or ruling is limited to the extent that its 33 enforcement would not directly conflict with the public policy of Arkansas.”

GEORGIA: Rep. Mike Jacobs (R) has introduced a bill that would “ban the use of Sharia law in state courts.” Jacobs says of the issue, “We’re seeing more of a feeling that Sharia law should be applied in domestic cases.” “Arbitration is a routine business exercise by people who are prepared to sacrifice some of their constitutional rights in return for reduced cost and expediency,” said Michael J. Broyde, a “member of the Beth Din of America — the largest Jewish law court in the country,” in response to the law. “[The bill would] incapacitate Georgia companies as they engage in international commerce.”

INDIANA: Indiana’s SRJ 16 would make it so that courts could not enforce a “law, rule, or legal code or system established and either used or applied in a jurisdiction outside the states of the United States, the District of Columbia, or the territories of the United States if doing so would violate a right guaranteed by this constitution or the Constitution of the United States.”

LOUISIANA: Louisiana passed a law guarding against “international law” being used in its courts in June 2010.

MISSISSIPPI: House bill 301 was introduced to ban “Mississippi courts from using foreign laws, including Sharia law, which is a guide to Islamic religious practice.”

NEBRASKA: Legislative Bill 647 aims to “prohibit Nebraska courts from using foreign laws in decisions.)” If passed, it will have to be voted on by Nebraska voters in 2011 because it is a constitutional amendment.

SOUTH CAROLINA: In South Carolina, Sen. Mike Fair (R) has introduced legislation to ban the implementation of Sharia law, saying there is “a need to clarify that cultural customs or foreign laws don’t trump U.S. laws.” He does admit, however, that his bill is “stating the obvious.”

TEXAS: State Rep. Leo Berman (R) recently introduced a constitutional amendment “prohibiting a court of this state from enforcing, considering or applying a religious or cultural law.” If the legislature passes the amendment, it will appear on the November 2011 ballot for Texas voters to approve.

SOUTH DAKOTA: South Dakota’s anti-Sharia bill is HRJ 1004, which says that no court “may apply international law, the law of any foreign nation, or any foreign religious or moral code with the force of law in the adjudication of any case under its jurisdiction.”

UTAH: Rep. Carl Wimmer (R) introduced a bill banning Sharia but then shortly withdrew it after being warned it could harm “international business,” admitting it was “too broad.” He is still looking for ways to ban Sharia.

WYOMING: State Rep. Gerald Gay (R) says his bill banning Sharia law is “a ‘pre-emptive strike’ to ensure judges don’t rely on Shariah [sic] in cases involving, for example, arranged marriages, ‘honor killings’ or usury cases.”

INGGRIS MENGANGGAP SYARIAH DISKRIMINATIF TERHADAP WANITA MUSLIM DAN MENGAMBIL TINDAKAN UNTUK MENGHENTIKAN PERKEMBANGANNYA. Ini nih kenapa syariah = diskriminatif.

• Kesaksian wanita di pengadilan hanya bernilai separuh kesaksian pria;
• Muslim bisa menceraikan istri dengan mudah yakni mengatakan kata ‘talaq’ tiga kali. Sebaliknya, Muslimah menghadapi kondisi yang lebih sulit untuk menceraikan suami Muslimnya, termasuk ijin dari pihak suami untuk dicerai, dan juga susah sekali mendapatkan tunjangan cerai dari pihak suami, dan semuanya ini didukung Pengadilan Syariah.
• Muslim dan anak² pria Muslim mendapatkan hak waris dua kali lebih banyak daripada Muslimah atau anak² perempuan;
• Dalam kasus² perkosaan, empat saksi Muslim diperlukan Pengadilan Syariah untuk bersaksi bahwa pihak wanita memang diperkosa;
• Pihak wanita tidak boleh bersaksi bahwa dia diperkosa di Pengadilan Syariah;
• Dalam kasus perceraian, hak asuh anak otomatis jatuh ke pihak bapak pada saat anak² telah berusia 7 tahun, sedangkan pihak ibu tak punya hak asuh apapun karena telah cerai; dan
• Semua hakim, pejabat pengadilan, dan saksi haruslah Muslim semua; non-Muslim tidak boleh mengambil bagian dalam bentuk apapun, dan tiada Muslimah yang boleh jadi hakim.
